Terms of Service

SmartSeller provides software for small businesses to build a website/online store, automate WhatsApp and Instagram conversations, take orders, and manage customers from one dashboard. We may add, change or remove features over time.

• You must provide accurate information and keep your login credentials secure.
• You are responsible for all activity under your account.
• You must be authorised to represent the business you register, and be at least 18 years old.

• Paid plans are billed in advance on the cycle shown at checkout. Prices are in INR and may exclude applicable taxes.
• You can try features before going live; certain channels require an active subscription to operate.
• If a payment fails or a subscription lapses, access to paid features may be paused until renewed.
• Refunds are handled per our Refund Policy.

When you connect WhatsApp, Instagram, Facebook or Google, your use of those channels through SmartSeller is also subject to those platforms’ own terms and policies (including Meta’s Platform Terms and WhatsApp Business policies, and Google’s API policies). You are responsible for the messages you send and for complying with anti-spam, consent and messaging- window rules. Messaging charges levied by Meta for WhatsApp are billed to you directly by Meta; SmartSeller charges only for its subscription.

You agree not to use SmartSeller to:

• send spam, unsolicited or unlawful messages, or content that violates a platform’s policies;
• sell prohibited goods or services, or infringe others’ intellectual-property or privacy rights;
• attempt to disrupt, reverse-engineer, or gain unauthorised access to the service.

We may suspend accounts that violate these Terms or put the platform or its users at risk.

You retain ownership of the content you put into SmartSeller (products, images, copy). You grant us a licence to host and process it solely to provide the service.

We work to keep the service reliable but provide it on an “as is” and “as available” basis, without warranties of uninterrupted operation.

To the extent permitted by law, SmartSeller is not liable for indirect or consequential losses, and our total liability for any claim is limited to the amount you paid us in the three months before the claim.

You may cancel at any time. We may suspend or terminate access for breach of these Terms. On termination your right to use the service ends; data handling follows our Privacy Policy.

These Terms are governed by the laws of India, with courts in India having jurisdiction.
